Please Note:

The price does not include connection to services and any heavy lifting or access equipment required (Crane Hire, Forklifts, Scissor Lifts, ladders, scaffolding etc).

 

Exclusions from Contract:

Off-loading on site and heavy lifting equipment which may be required to locate the equipment at its installation point, crane hire etc.

Any access equipment, which may be required, i.e., access towers, roof crawler boards and ladders for access above 3 metres high.  Any special safety equipment which may be required to conform to local hazardous conditions.

It is the responsibility of the client to appoint only an Approved Contractor to carry out the electrical installation and machine connection in accordance with current Wiring regulation.  A “Certificate of Inspection and Completion” should be obtained from the Contractor and a copy of the same should be sent to this office to ensure validation of warranty.  Failure to submit “Certificate of Inspection and Completion” within 7 days of completion will automatically invalidate warranty to all electrically powered items and switchgears.

Failure to comply with any of the above invalidates all electrical motor and electric control panel warranties.

Any deviation from the above exclusions must be agreed in writing and signed by both parties.

 

Validity:

Quotations are valid for 30 days from date of issue.

Prices:

The price quoted in this offer is valid for 30 days from the offer date.

Carriage:

Will be included in the quoted price unless stated otherwise in the quotation.

PACKAGING AND DELIVERY

(a) The delivery date set out in an acknowledgement of order is an estimate only and the Seller shall be under no Liability for any delay or the consequences of any delay. Time is not of the essence in relation to delivery dates.

(b) The Seller will notify the Purchaser as soon as reasonably practicable of the actual delivery date for the Products and all relevant unloading requirements. If delivery is earlier than estimated the Purchaser shall accept delivery as soon as the Seller is able to deliver.

(c) The Purchaser shall unload the Products on arrival at the Purchaser’s premises, position the Products on a suitably prepared foundation and arrange for all necessary utilities to be connected to the Products.

(d) The extent of packing and/or protection necessary will be at the Seller’s discretion. The cost of such packaging and also delivery shall be included in the price of the Products. Any other packing requirements stipulated by the Purchaser will be at the Purchaser’s risk and cost.

(e) The Seller shall be under no liability whatsoever for any loss or damage caused or injury suffered as a result of the unloading of the Products unless the Seller shall have undertaken such unloading.

Damage in Transit:

Notification of any such damage must be forwarded to us and carriers within three days of receipt of goods.

Guarantee:

New machines and goods factored by us, are covered by appropriate manufacturers standard guarantee and conditions of contract.

Liability:

No liability can be accepted for damage or loss either consequential or direct, whether to the purchaser or third parties that may arise after goods have left our premises, or site where lying. No liability can be accepted for any work whatsoever, for our account, unless agreed by us in writing.

Deposit:

All deposits received will be deemed as an order and can only be refunded with our written consent.

Cancellation:           

Cancellation of orders cannot be accepted without our written consent.

Retention of Title to goods:

The property in all goods supplied by us and covered by this contract shall not pass to the buyer but shall remain vested in Maginn Machinery Company Limited until payment in full is received.

SETTLEMENT

Strictly net cash.

All goods/services must be paid within the terms stipulated without prejudice to any of the rights of the supplier.

HEALTH & SAFETY

(a) The Seller shall use all reasonable endeavours to ensure that the Product conforms to EC safety regulations applicable at the time of sale and that the Product supplied by it is safe and without risks to health when properly used.

(b) The Purchaser undertakes with the Seller that it will ensure compliance so far as is reasonably practicable with any instructions given by the Seller or the manufacturer for the purpose of ensuring that the Product will be safe and without risk to health when properly used in accordance with the manufacturers user manual and will take any other steps or precautions having regard to the nature of the Product as are necessary to preserve the health and safety of persons handling or using it.

(c) It shall be the responsibility of the Purchaser to take all necessary steps to comply with any changes in any health and safety legislation and to comply with requirements of such legislation in so far as they relate to the Purchaser’s particular circumstances.
